Nairobi residents are set to begin reaping benefits from the Northern Water Collector Tunnel that has been under construction in Murang&rsquo;a County as completion is scheduled for April this year.

The World Bank-funded water project located in Makomboki area of Murang&rsquo;a County is 91 per cent complete and is expected to be launched before June of this year. A recent inspection tour of the project by four cabinet secretaries led by Amina Mohammed (Sports) accompanied by Joe Mucheru (ICT), Simon Chelugui (Labour) and Sicily Kariuki (Water) confirmed the progress of the project.

The project which is Kenya&rsquo;s longest tunnel is designed to harness floodwater from three rivers in Murang&rsquo;a County in order to increase water volumes at Ndakaini dam by up to 152,000 cubic metres daily. Ndakaini dam is the main water supply source for Nairobi where water supply issues have been a perennial problem in most city estates.

The city currently gets 580,000 cubic meters of water daily against a demand of 750,000 cubic meters per day. According to Pumps Africa, components of the KSh 21.9 billion project include a water treatment plant installed at a cost of KSh 7.1 billion, a 56Km pipeline to Nairobi constructed at KSh 5 billion, and the tunnel will cost KSh 7.5 billion.

The project which is being implemented by the national government involves the construction of river intake structures at Maragua, Gikie and Irati rivers plus construction of access adits at Gikigie, Irati and Kaanja.

Sports CS Amina Mohammed said the project package will include smaller water projects that will increase water connections to local communities in Murang&rsquo;a, Gatanga, Ichichi and surrounding areas.

City Hall is planning to augment its technological capacity in running the affairs of Nairobi County. The county government recently published the Nairobi County Annual Development Plan, which outlines strategies to improve the operations of the city’s authorities. The plan is an annual component of the 5-year County Integrated Development plan

The plan outlines that the county government is working to acquire an Integrated City Management System (ICMS).

‘This will be the core application to automate the County’s business processes and will cover functionalities such as Revenue Management, Human Resource, Procurement, Citizen Services and specialised departmental functions, Fleet Management, Projects Management, Performance Management and others,’ reads the plan

Other applications such as e-Payment, IFMIS, Web Portal, Citizen Relationship Management System and Business Intelligence are to be integrated with the ICMS. Nairobi County intends to implement phase 1 of the ICMS application in the FY 2018/19 over a 5-years period.

Key components of the ICMS will include the Citizen Relationship Management (CRM) solution to be acquired in the FY 2019/2020 that will manage interactions with citizens and provide the County a single view of citizens. The system will also be used to track feedback and complaints.

In addition, the County intends to put in place a Business Intelligence &amp; Analytics tool solution in the FY 2019/2020 to have a better analytical solution and reporting to support decision-making.

This is expected to be deployed to manage spatial data to support planning and service delivery. The Nairobi City County Lands and Housing Sector with support from The Nairobi Metropolitan Services Improvement Project (NaMSIP), will be implementing the system in FY 2019/2020.

The recently published Tax Laws (Amendment) Bill, 2020 has elicited mixed reactions from tax experts, legal and sector players.

The bill follows President Uhuru Kenyatta’s address on 25th March that set out fiscal plans to combat the economic impact of COVID-19 on Kenyans.

Kenya Revenue Authority attached to the President’s tax relief measures a significant number of changes in the bill which proposes to make amendments to tax-related laws in Kenya including the Income Tax Act (CAP 470), VAT and other tax laws.

Tax experts say the new law would adversely affect the real estate industry. First, the bill proposes to abolish two key exemptions on capital gains tax (CGT) from the First Schedule to the Income Tax Act.

The act allows CGT exemption for a private residence if the individual owner has occupied the residence continuously for the three-year period immediately prior to the transfer, and a CGT exemption where the land sold has a value of less than KES 3 million (approx. USD 30,000) or consists of agricultural land outside a municipality and which is less than 50 acres in size.

According to Anjarwalla &amp; Khanna advocates, the move would negatively affect investments in the affordable housing program and impair the long-term savings of Kenyans who acquire homes. In addition, it would be counterproductive to the government’s intention of protecting low-income Kenyans.

The bill also proposes to delete the provisions in the Income Tax Act relating to House Ownership Savings Plan (HOSP) which will do away with tax deductions allowed in respect to contributions made to any registered HOSP. The current regime provides an incentive for first-time home-buyers, which is in line with the government’s Big Four Agenda.

The bill also proposes to overhaul the investment allowances regime under the current income tax act with the following changes:

For commercial buildings, the new bill also proposes to reduce the rate of capital allowances from 25 percent to 10 percent on a reducing balance basis

For hotel buildings, the new rate will be 50 percent for the first year and 25 percent for subsequent years on a reducing balance basis excluding cost of land. The current rate in Income Tax Act allows for 100 percent deduction in the first year of use.

Capital allowances of 10 percent on a reducing balance basis for student hostels and other educational buildings, from the current rate of 50 percent. The educational building must be licensed by the competent authority for the investment allowance to be deducted.

“In our view, therefore, it would be preferable for the Government to pass the emergency measures intended to mitigate the effects of COVID-19 first, and to expose the far-reaching tax measures to adequate public participation as required by the Constitution of Kenya,” said Legal firm <a style="color: #ff6600;" href="https://www.africalegalnetwork.com/kenya/news/the-tax-laws-amendment-bill-2020/">Anjarwalla &amp; Khanna</a> in a review of the new scheme.

The bill is due for discussion in parliament on 8th April, 2020 before the President may assent to it as law.

Nairobi County outlines plan to adopt technology

The Nigerian Government, last week signed a Memorandum of Understanding (MoU) for the erection of 100,000 housing units across the nation.

The MoU was signed with Shelter Afrique and the Real Estate Developers Association of Nigeria (REDAN).

Nigeria has a housing shortage- between 17 to 20 million units; hence this most recent scheme is a noteworthy stride towards providing inexpensive housing for Nigerians.

The Acting Managing Director/Chief Executive, Federal Mortgage Bank of Nigeria in Abuja, Mr. Richard Esin, who represented the government at the MoU signing ceremony, affirmed that the Nigerian housing market did not need anything less than US $200m yearly over the next 10 years to put up a substantial number of houses.

About 10,000 housing units are set to be built every year for the next ten years at an outlay of US $200 billion year on year, amounting to a whole sum of US $2 billion (610 billion naira).

Mr. Esin also said that the housing scheme is estimated to generate 100,000 jobs across the nation.

Shelter Afrique is a pan-African finance institution set up to solely support the development of the African real estate and housing sector. The establishment has exhausted more than US73.6 m (N22.51) bn on housing schemes in Nigeria.

REDAN’s Company President Mr. Ugochukwu Chime said the signing of the MoU was a highlight in housing delivery and lauded the Minister of Power, Works and Housing for the success of the accord.

The Ministry of Lands is overseeing the development of a National Land Valuation Index to guide land valuations in the country.

The process which involves data collection and inspection is currently being undertaken in five counties including Kajiado, Kiambu, Nakuru, Machakos and Meru.

According to the Ministry, data collection and inspection has already been completed in 11 counties including Nyamira, Kakamega, Garissa, Busia, Bungoma, Vihiga, Lamu, Isiolo, Marsabit, Tana River and Siaya.

The Ministry said the data has been collated and is ready for stakeholder review for further engagement.

&ldquo;We have been carrying out this process in 17 counties in the 3rd and 4th quarter of this financial year,&rdquo; the Ministry said.

Ministry of Lands in conjunction with other key stakeholders has embarked on preparation of the National Land Valuation Index to provide a credible valuation database for use in investment and land compensation decisions.

For the National Land Valuation Index exercise, the Ministry <a href="https://lands.go.ke/wp-content/uploads/2020/12/NEWSLETTER-18TH-DECEMBER-2020.pdf" style="color: #ff6600;">said</a> it has developed value zone maps for Mombasa, Kericho, Bomet, Kisumu, Narok and Nakuru counties which should lead to predictable planning for investment by both the public and private sectors.

In 2019, the <a href="http://www.parliament.go.ke/sites/default/files/2018-09/Land%20Value%20Index%20Laws.pdf" style="color: #ff6600;">Land Value Index Bill</a> was passed into law. It provides that the valuation of freehold land and community land for purposes of compensation under the act shall be based on the land value index developed jointly by the national government and county government.

As part of its ongoing digitization program, the Ministry said it will initiate the process of digitizing land records and processes in Ruiru, Kiambu, Kajiado, Ngong and Machakos in the 2020/ 2021 financial year.

New National Land Valuation Index Under Development, Says Ministry

A new report by Verisk Maplecroft’s, the Climate Change Vulnerability Index (CCVI), which assesses the threat from climate change over the next 30 years has established that 84% of the top 100 cities by population are at ‘extreme risk’, with a further 14 in the ‘high risk’ category.

According to the data, rapid growth, rising temperatures and increasingly severe weather events brought on by climate change are putting companies and investments at risk.

Maplecroft further say that 95% of the 234 cities considered ‘extreme risk’ in the CCVI are in Africa and Asia, compounding fears that the world’s poorest countries are set to pay the highest price of climate change.

The Index by Verisk Maplecroft emphasises how urban climate impacts will have significant implications for major corporates operating on a global level with supply chains throughout the world. Already, there is growing evidence pointing to the fact that the world's poorest countries will incur more liability in comparison to their richest counterparts by having to pay a higher price for the rising temperatures.

The major physical risks to investments cited include damage to infrastructure, property and assets caused by tropical cyclones or flooding, all of which are set to become more severe and frequent in the coming decades due to ongoing climate change. Drought, crop failure and instability brought on by climate change may also compound the risks by driving even larger numbers of people towards cities through cross-border and rural migration.

Richard Hewston, principal Climate Change and Environment Analyst at Verisk Maplecroft <a href="https://www.businessgreen.com/bg/news-analysis/3066311/why-surging-city-populations-could-pose-a-major-climate-risk-for-businesses">explained</a> that "Businesses operating in megacities have to understand the physical risks in the short, medium and long- term," he said. "They must work to build their resilience to climate shocks, not only to protect their assets and people, but also to satisfy investors that are increasingly factoring climate risk into their investment process."

86 of the 100 fastest growing cities in the world are in Africa, of which as many as 79 are rated at 'extreme risk' in the Index. These include Kampala in Uganda, Dar-es-Salaam in Tanzania, Abuja and Lagos in Nigeria, Addis Ababa in Ethiopia, and Luanda in Angola, where populations are all set to continue surging over the coming decades.

The report estimates that the amount of GDP in African countries exposed to these 'extreme risk' in the Index will grow from $895bn this year to almost $1.4tr in 2023, which represents nearly half of the continent's entire GDP.
