The Kenya Urban Roads <a href="https://kura.go.ke/" rel="noopener noreferrer" target="_blank">Authority</a> (KURA) has announced plans to construct two elevated carriageways in the city centre.

The new project is patterned after the Nairobi Expressway currently under construction by the Kenya National Highways Authority (KeNHA).

KURA explained that the new infrastructure will involve the construction of two elevated carriageways along Valley Road-Kenyatta Avenue junction around Integrity Centre through to the CBD and Ngong-Nyerere Road interchange through to Upper Hill-Haile Sellasie Avenue.

&ldquo;The elevated carriageways are two, one from Integrity Centre to Serena (Hotel) and another on the Milimani Close,&rdquo; said KURA Resident Engineer Benjamin Asin.

The two overpasses are supposed to link Ngong Road to Nairobi&rsquo;s CBD and unlike the Nairobi Expressway which is supposed to ease traffic and pass over the CBD. The KURA official said the initial phase of relocating existing service infrastructure is already ongoing.

The roads authority on Monday held a stakeholders consultation meeting on the proposed construction.

&ldquo;At the moment, we are doing preparatory works that involve the relocation of works planning and geotechnical investigations,&rdquo; he said.

He revealed that the overpasses will be designed to approach the Nairobi Expressway at lower levels emptying traffic into the CBD through Kenyatta Avenue and Haile Selassie Avenue.

&ldquo;There will be no connection because that one is for traffic that is going express so we do not want to mix, so as traffic approaches the Expressway, it will go down and into the city,&rdquo; said Engineer Benjamin.

Kura said the project will not involve the demolition of any buildings but will chip into portions of land owned by All Saints Cathedral, Millimani Commercial Court, and some along Nyerere Road.

The project is estimated to be completed by 2023 and the work has been assigned to China Road and Bridge Corporation. The project is budgeted to cost Ksh. 2.9 billion.

State Department of Housing and Urban Development PS Polycap Hinga recently announced on his twitter handle that the blue print for Nairobi’s Railway City is ready for implementation.

Railway city, will be established in the heart of Nairobi surrounded bordering industrial area to the South and the CBD to the north, on a 172-ha piece of land including 118 ha of land belonging to Kenya Railways.

The city which is meant to expand and revitalize Nairobi’s CBD, will host a new central railway station designed to be a multi-modal hub within the CBD. The new station will ensure a seamless connection among Commuter rail, 3BRTs, Airport Limousine, City bus, and Bicycles. Railway City is designed to link to Nairobi’s traditional CBD via Moi avenue.

According to the blue print, Nairobi Railway city will host multi-modal transit stations, mixed use/commercial buildings, international offices, SME cluster and high-tech industry buildings, residential buildings, community and government buildings, rich open space and plazas, and powerful non-motorized/pedestrian walkways.

The proposed city transportation plan will integrate various transportation plans including mixed traffic carriage ways, bus lanes, pedestrian walkways, pedestrian corridors and cycle lanes. In the new plan, rail transport will make up to 16% of the transport facilities provided in the city while walking facilities will still be the highest (45.8%).

A rail system will ease congestion on links around the Railway City, especially Uhuru Highway, Haile Selassie Avenue, Landhies Road according to the plan.

Railway city company, the chief developer, will be responsible for ensuring an appropriate spread of essential social facilities across the city. The city is projected to host a residential population of 27,534.

Implementation of the plan is estimated to cost about KES 27.9 billion for putting up the infrastructure for the railway city which will include landscaping, roads &amp; pavements, railway infrastructure, water supply, sewerage systems, telecommunications and power.

The implementation plan is projected to take 20 years and is divided into three phases. Phase one involves developing basic infrastructure (2020-2030), phase two for activation of the city’s economy (2030-2035), and phase three which will allow for spontaneous development following planning and development guidelines.

‘The city is designed to be a new central economic zone, Integrated multimodal hub, Green TOD with iconic urban space,’ says the draft report presented to MCAs at a workshop in May 2019.

The KPSP project is co-creating innovative spaces with residents that not only reduce flood risk but provide essential services, like water and sanitation, and new ways for businesses to thrive.

&ldquo;The Kibera Public Space Project provides a model for sustainable development that addresses a range of objectives in a cohesive way, not only recreational public space, but also economic development and environmental remediation,&rdquo; Regina Opondo, community director, Kounkuey Design Initiative Nairobi Office said.

&ldquo;With public spaces that provide access to safe and affordable water, sanitation, flood protection, and income-generating opportunities for tens of thousands of Kibera residents, KPSP builds resilience to climate risks in the most vulnerable neighbourhoods,&rdquo; she added.

This year&rsquo;s Prize for Cities competition drew more than 260 applications from around the world with the five finalists being selected from Argentina, India, Kenya, Mexico and the UK.

The WRI Ross Centre for Sustainable Cities is a programme run by the World Resources Institute (WRI), a global research organization that spans more than 60 countries.

WRI said the finalists show that cities can be more sustainable and productive for more residents through empowering, participatory and climate-smart changes.

&ldquo;In an extraordinarily challenging year, these projects show the resilience and creativity of cities&ndash; that partnership between community groups, government and business can lead to significant change with multiple co-benefits,&rdquo; said Ani Dasgupta, global director, WRI Ross Centre for Sustainable Cities.

&ldquo;These types of innovations are more important than ever, as cities are a crucial building block in an inclusive, resilient recovery from the Covid-19 pandemic,&rdquo; said the statement from WRI.

&ldquo;As cities seek new solutions to jumpstart their economies and become more resilient, these projects show how we can build cities that work better for people and the planet,&rdquo; Dasgupta said.

The finalists will be evaluated by an independent jury of urban thinkers and leaders from outside WRI who will determine the winner of the grand prize of $250,000. The four runners up will each receive $25,000.

Kibera Public Space Project Selected for KSh. 27 Million Global Award

The United Nations agency, UN-Habitat has initiated a programme to build about 8,000 units in Mavoko, Machakos County. The KSh. 20 billion project is geared towards resettling about 40,000 slum dwellers from the Nairobi metro area.

“UN-Habitat is developing a strategy to support affordable housing project under the Big Four agenda. We plan to put up between 6,000 and 8,000 affordable housing units for the urban poor on a 55-acre piece of land in Machakos County,” said Dr Chiramba, UN-Habitat’s head of housing projects in the region.

He was speaking at a media briefing ahead of the UN-Habitat Assembly to be held in the country for the first time, from the 27th to 31st of May at the UN headquarters in Gigiri, Nairobi. The assembly will be the first major intergovernmental conference to be held on urban development issues in Nairobi with a focus on how to better implement the New Urban Agenda adopted in 2016 and the Sustainable Development Goals.

More than 2,000 delegates are expected from all parts of the globe, including heads of state and ministers, 168 mayors and governors, 378 NGOs, 261 private-sector players, 26 foundations, and 300 from academia and several UN agencies.

The assembly will have more than 70 exhibitors showcase their best innovations on improved urban planning, sanitation, housing and public transport et cetera. According to UN-Habitat, the number of slum dwellers in Kenya has risen to 6.4 million or 56% of the country’s total urban population despite past slum upgrading programs.

“Our objective is to create neighbourhoods of affordable, low-cost and good-quality housing for inhabitants relocated from informal settlements,” said Dr Chiramba.

Groundbreaking for the Mavoko project is set to take place in five months’ time. The project will be built on land donated by UN body, UN-Habitat is working on the project’s financing. Dr. Chiramba said they have identified some possible beneficiaries who are members of Saccos in informal settlements.

Railway City to Brace Nairobi’s CBD

Twenty-five residents of Manda Islands have lost a court case to the Kenya Airports Authority (KAA) for the continued occupation of a parcel of land belonging to Manda airport.

The residents had brought a claim to the land with a push for adverse possession. However,<a style="color: #ff6600;" href="http://kenyalaw.org/caselaw/cases/view/149694#:~:text=%E2%80%9CAdverse%20Possession%20is%20essentially%20a,%2C%20in%20Kenya%2012%20years.%E2%80%9D"> Environment and Land Court</a> Judge Justice James Olola found that KAA was the registered owner of the 194 hectares of land in dispute.

According to a ruling by the Court of Appeal in 2005, “Adverse Possession is essentially a situation where a person takes Possession of land, asserts rights over it and the person having title to it omits or neglects to take action against such person in the assertion of his title for a certain period, in Kenya 12 years.”

The law requires certain thresholds to be met before the application for adverse possession can be granted.

It stipulates that a plaintiff must show they have been in continuous possession of the land for 12 years or more; that such Possession has been open and notorious to the knowledge of the owner and that they have asserted a hostile title to the owner of the property.

However, Justice Olola found that the 12 years had not elapsed by the date of filing the case in 2014 thus a claim for adverse possession was not possible.

In addition, he said the residents’ claims to the land of no basis since a perusal of grant produced in court confirmed it was registered in the name of KAA.

In 1975, the court held that acts of Adverse Possession “must be actual, visible, exclusive, open and notorious,” a statement affirmed by a 2002 case where the court held that “a person who seeks to acquire title to land by the method of Adverse Possession for the applicable statutory period must prove non-permissive or non-consensual actual, open, notorious, exclusive and Adverse use by him or those under whom he claims for the statutory prescribed period without interruption.”

Yet Justice Olola found evidence to show that the residents were made aware of their infringement on the ownership of the land by KAA.

In its defence, KAA had said the continued occupation of the land was illegal and an infringement on its property ownership rights. Furthermore, it said the residents continued occupation of the land would compromise airport safety and security.

“KAA has proved on a balance of probability that it was entitled to the orders brought in the counterclaim,” ruled Justice Olola.

The court issued a permanent injunction compelling the residents to vacate the parcel of land.

Civil servants evicted from old government estates to make way for new buildings will be given top priority in the allocation of completed housing projects, the state’s housing department has said.

“Civil servants who were occupying the Park Road Estate and were given notices to vacate to allow for the construction of the on-going Affordable Homes Project will be given the first priority to purchase the constructed units,” said the Housing department.

The civil servants will be required to avail evidence of occupation to the Civil Servants Housing Scheme Fund secretariat for approval.

A statement from the Ministry of Transport, Infrastructure, and Housing said it will soon begin advertising for sale some of the 1370 units currently under construction by a Chinese contractor. The units are expected to be completed before the end of the year.

The rest of Kenyans interested in purchasing the houses are free to apply through the <a style="color: #ff6600;" href="https://bomayangu.go.ke/">Boma Yangu portal</a> which has received 270,000 applications so far according to the Ministry.

For buyers to qualify for allocation, they need to have saved 12.5 percent of the selling price before getting a mortgage to offset the balance at nine percent interest for up to 25 years. The Kenya Mortgage Refinance Company will aid banks in providing low-interest loans to Kenyans.

In December, the State Department of Housing revealed that 17,000 Kenyans have begun making voluntary contributions to the State’s affordable housing plan affirming that demand for the houses was in fact high. Charles Hinga.

Housing PS remains confident the 500,000 houses target will be achieved since the project has received over Ksh1 trillion in funding commitments by investors. Last month the PS received the first batch of <a style="color: #ff6600;" href="https://estatecloud.co.ke/228-units-of-affordable-housing-so-far-complete/">228 units</a> completed by the Chinese contractor.

Evicted civil servants to get top priority in affordable housing allocation

Lancet Housing Co-operative Society Ltd have broken ground on the Sh.1.2 billion Lancet Village mixed use development.

Located in the suburb neighbourhood of Katani, Lancet Village is 25km from the Nairobi Central Business District and only 10 minutes drive from Syokimau Main Railway station and Jomo Kenyatta International Airport(JKIA).

Lancet Village is a Gated Community made up of 2-Bedroom Apartments, 3-Bedroom Apartments, 4-Bedroom Maisonettes, Commercial area and Kindergarten each with ample parking spaces for both the residents and visitors.

The developer aims to construct 188 units within a span of 24 to 30 months and on the 10-acre piece of land. The project was initiated by the Lancet Housing Co-operative Society which belongs to the staff members of the medical laboratory services operator Lancet Kenya.

Lancet officials have said that 50 per cent of the units have already been booked by Lancet but the remainder are open to the public on offset plans. On the prices, two-bedroom, three-bedroom and four-bedroom apartments can be purchased for Sh. 5 million, Sh. 6.5 million and Sh. 10 million.

The units are designed in courts to enhance security, identity and smaller management units. According to the project’s designers, the gated community will provide spacious outdoor areas while retaining privacy adding that Lancet Village brings out a living space that integrates well with the community living within and the natural landscape.

Katani area has benefited from infrastructural developments in the area including the ongoing Katani road and the SGR. Increased accessibility has raised residential interest in the area.
